1. Applicability of the General Terms and Conditions for Online Trade
Deliveries and services from www.taizespirit.com; owner: Charlotte Riedl-Würfel, Hildebrandtgasse 3, 5020 Salzburg to consumers are made exclusively on the basis of the following General Terms and Conditions for Online Trade (GTC-Online) in the version valid at the time of the order. Deviating provisions will only be effective if they have been agreed in writing. The GTC-Online of www.taizespirit.com also apply to future orders from the customer, even if they are not explicitly agreed upon again; in this case, the current version of the GTC-Online at the time of the future order is decisive. The customer can view, download, and print the currently valid version of the GTC-Online on the website www.taizespirit.com.
2. Conclusion of Contract
Contractual partners are the customer and www.taizespirit.com, owner: Charlotte Riedl-Würfel, Hildebrandtgasse 3, 5020 Salzburg. The contractual, order, and business language is German and English.
The offers on the websites of www.taizespirit.com, owner: Charlotte Riedl-Würfel are a non-binding invitation to the customer to order goods. By ordering goods, the customer submits a binding offer. The order can be placed by filling out and submitting the online form on the internet, via e-mail, or by post. The customer's offer becomes effective as soon as the order has been received by www.taizespirit.com, owner: Charlotte Riedl-Würfel.
www.taizespirit.com, owner: Charlotte Riedl-Würfel can accept an offer within 7 working days of receipt. After the unused expiry of this period, an offer is considered rejected. Acceptance is made by sending an order confirmation or by sending the ordered goods. The dispatch date is decisive for observing the acceptance period. Order confirmations can also be sent by e-mail.
Should the order confirmation or any other legally binding declaration from www.taizespirit.com, owner: Charlotte Riedl-Würfel contain typing or printing errors, or should transmission errors underlie the price determination, www.taizespirit.com; owner: Charlotte Riedl-Würfel is entitled to challenge the declaration due to error, whereby www.taizespirit.com, owner: Charlotte Riedl-Würfel bears the burden of proof regarding the error. Any payments received will be refunded immediately in this case.
3. Nature of the Purchased Item
The nature of the purchased item underlying the contract results exclusively from the manufacturer's specifications. Production-related deviations and improvements to products do not constitute a reason for complaint and may deviate slightly from the product description.
4. Prices and Payment Terms
Billing is in Euro (EUR). Prices quoted are exclusive or inclusive of statutory value-added tax. The price indication of net prices (= exclusive of VAT) or gross prices (= inclusive of VAT) is explicitly displayed on the websites. Costs for packaging and shipping are invoiced separately. The transport and packaging costs for shipments in Austria, Germany, and beyond are shown to the user in a shipping cost table.
All prices apply only to shipping within Austria and EU countries. The prices valid at the time of the order are always decisive. With the update of the websites of www.taizespirit.com, owner: Charlotte Riedl-Würfel, all previous prices and information about goods become invalid. Separate costs apply for packaging and shipping. Please refer to the "Shipping Costs" section in our shop footer for these.
Furthermore, shipping outside the EU is also possible. Here too, the prices valid at the time of the order are decisive. Separate costs apply for packaging and shipping, which you can find in the shipping cost table.
Payment is made by invoice. Please refer to the "Payment Conditions" section in our shop footer for our valid payment terms.
The payment amount shown on the invoice must be paid in full to www.taizespirit.com, owner: Charlotte Riedl-Würfel, regardless of the payment method. Deductions for transaction fees and similar charges that may arise, for example, when paying through international banks, are not accepted by www.taizespirit.com, owner: Charlotte Riedl-Würfel.
5. Right of Withdrawal Information
Consumers have a fourteen-day right of withdrawal.
5.1. Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, have taken possession of the last goods.
To exercise your right of withdrawal, you must inform us (www.taizespirit.com, owner: Charlotte Riedl-Würfel, Hildebrandtgasse 3, 5020 Salzburg, Austria, Email: service@taizespirit.com) by means of a clear statement (e.g., a letter sent by post or e-mail) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, which is not mandatory. We will immediately inform you of the receipt of your withdrawal.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
5.2. Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. For goods that, due to their nature, cannot normally be returned by post, these costs amount to EUR 100 for shipping from Austria, EUR 150 for shipping from Belgium, Germany, Luxembourg, Netherlands, Hungary, Switzerland, Slovakia, Slovenia, and the Czech Republic, and EUR 250 for shipping from the remaining EU countries. You only have to pay for any diminished value of the goods if this diminished value is due to handling them in a way that was not necessary for checking the nature, characteristics, and functioning of the goods.
The right of withdrawal does not apply to the following contracts:
Contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

6. Delivery Conditions
Deliveries are made to the delivery address provided by the customer.
Delivery is made by Austrian Post, by a private parcel service, or by a forwarding agent.
The delivery period results from the electronic catalog. Information about delivery periods is non-binding, unless a delivery date has been bindingly and explicitly promised in writing. We will, in any case, deliver within the legal period of 30 days.
All deliveries are subject to www.taizespirit.com, owner: Charlotte Riedl-Würfel being supplied punctually and correctly by the Communauté de Taizé. Should a product ordered by the customer not be available for reasons for which www.taizespirit.com, owner: Charlotte Riedl-Würfel is not responsible, www.taizespirit.com, owner: Charlotte Riedl-Würfel will inform the customer immediately. In this case, the customer has the right to withdraw from the contract. If the customer does not withdraw, www.taizespirit.com, owner: Charlotte Riedl-Würfel may deliver a product of equivalent quality and price instead of the ordered product or withdraw from the contract themselves. If the customer or www.taizespirit.com, owner: Charlotte Riedl-Würfel withdraws from the contract, www.taizespirit.com, owner: Charlotte Riedl-Würfel will immediately refund any payments already made by the customer.
If www.taizespirit.com, owner: Charlotte Riedl-Würfel is in default of delivery for reasons for which it is responsible or if a delivery becomes impossible for such reasons, without www.taizespirit.com, owner: Charlotte Riedl-Würfel being accused of intent or gross negligence, the liability of www.taizespirit.com, owner: Charlotte Riedl-Würfel for damages is excluded. Other claims of the customer remain unaffected. In particular, the customer can withdraw from the contract by setting a reasonable grace period.
In the event of delivery delays for which www.taizespirit.com, owner: Charlotte Riedl-Würfel is not responsible (force majeure, fault of third parties, etc.), the delivery period will be extended appropriately. The customer will be informed of this immediately. If the causes of the delay last longer than 4 weeks for www.taizespirit.com, owner: Charlotte Riedl-Würfel, each party is entitled to withdraw from the contract.
7. Retention of Title
The ordered goods remain the property of www.taizespirit.com, owner: Charlotte Riedl-Würfel until full payment.
Before the transfer of ownership, dispositions of the goods (resale, rental, pledging, security transfer, processing, reshaping, etc.) are not permitted without the express consent of www.taizespirit.com, owner: Charlotte Riedl-Würfel.
8. Transport Damages; Customer's Obligation to Examine and Report Defects
Delivered goods must be inspected immediately for external and internal damage, or if goods with obvious damage to the packaging or contents are delivered, the customer must immediately report this to the forwarder/delivery person/freight service and accurately note the damage on the acceptance slip in writing or refuse acceptance. In addition, www.taizespirit.com, owner: Charlotte Riedl-Würfel must be contacted immediately.
Hidden defects must be reported to www.taizespirit.com, owner: Charlotte Riedl-Würfel immediately after discovery.
Compliance with the obligations under 8.1. and 8.2. has no influence on the customer's warranty claims.
9. Warranty
The customer's warranty claims against www.taizespirit.com, owner: Charlotte Riedl-Würfel for defects in the delivered goods are governed by statutory provisions, unless deviations arise from the following regulations. The warranty period ends 24 months after delivery.
Damages caused by improper or contractually non-conforming actions of the customer during the installation, connection, operation, application, or storage of the goods do not establish a claim against www.taizespirit.com, owner: Charlotte Riedl-Würfel. The impropriety and non-conformity are determined, in particular, by the manufacturer's specifications.
10. Liability
www.taizespirit.com, owner: Charlotte Riedl-Würfel is only liable for property damage if www.taizespirit.com, owner: Charlotte Riedl-Würfel or its vicarious agents have caused it intentionally or through gross negligence. www.taizespirit.com, owner: Charlotte Riedl-Würfel is liable for personal injury caused by any culpable action of www.taizespirit.com, owner: Charlotte Riedl-Würfel or its vicarious agents.
It is the customer's responsibility to secure their data. www.taizespirit.com, owner: Charlotte Riedl-Würfel is not liable for data loss of the customer on products purchased from www.taizespirit.com, owner: Charlotte Riedl-Würfel with storage media (controllers, kiln controls, etc.), unless www.taizespirit.com, owner: Charlotte Riedl-Würfel or its vicarious agents have caused the data loss at least through gross negligence.
11. Prohibition of Offsetting and Right of Retention
The customer is not entitled to offset their own claims against claims of www.taizespirit.com, owner: Charlotte Riedl-Würfel, unless
the customer's claims have been acknowledged by www.taizespirit.com, owner: Charlotte Riedl-Würfel or have been legally established by a court, or
the customer's claims have their legal basis in the same legal transaction as the claims of www.taizespirit.com, owner: Charlotte Riedl-Würfel, or
www.taizespirit.com, owner: Charlotte Riedl-Würfel is insolvent.
The customer is not entitled to withhold payments due to their own claims against www.taizespirit.com, owner: Charlotte Riedl-Würfel, unless
www.taizespirit.com, owner: Charlotte Riedl-Würfel does not perform its services from the same transaction or does not perform them properly, or
the performance of the service by www.taizespirit.com, owner: Charlotte Riedl-Würfel from the same transaction is endangered due to the poor financial situation of www.taizespirit.com, owner: Charlotte Riedl-Würfel.
12. Data Protection
Data processing is carried out in accordance with statutory provisions. Customer data is processed for contract fulfillment, delivery, and accounting. www.taizespirit.com, owner: Charlotte Riedl-Würfel reserves the right to other types of data processing, insofar as these are legally permissible.
Customer data is exclusively collected, processed, used, and passed on to commissioned partners, insofar as this is necessary for the establishment and execution of the purchase contract and the further business relationship between the customer and www.taizespirit.com, owner: Charlotte Riedl-Würfel. The customer can object to this data application to www.taizespirit.com, owner: Charlotte Riedl-Würfel due to the infringement of overriding legitimate interests in confidentiality arising from their particular situation. All our vicarious agents are obliged to comply with the data protection law.
The invoicing data is stored internally within the company and can be provided at any time upon customer request to the email address service@tzetpy.eu.
13. Invalid Clauses
Should one or more provisions of these GTC-Online be invalid, this shall not affect the validity of the entire contract. The invalid provision will be replaced by the relevant statutory provision.
14. Place of Jurisdiction and Applicable Law
The sole place of jurisdiction is the headquarters of www.taizespirit.com, owner: Charlotte Riedl-Würfel. Therefore, the competent court is in Salzburg/Austria.
These GTC-Online and the contracts to be concluded under these GTC-Online are subject to Austrian substantive law. The applicability of the UN Convention on Contracts for the International Sale of Goods is excluded.
17. Place of Performance
The place of performance for all transactions is the company's location in Salzburg/Austria.
18. Miscellaneous
The European Commission provides a platform for online dispute resolution (OS), which you can find here http://ec.europa.eu/consumers/odr/.
We are prepared to participate in an out-of-court arbitration procedure before a consumer arbitration board.
